COTTAGE TERMS & CONDITIONS
CONDITIONS OF BOOKING
1. DEFINITIONS & Interpretation
In these terms and conditions (Conditions) the following definitions shall apply:
1.1 “you” means the organisation, company or individual who makes a booking for hire of any Cottage(s) and being the person responsible for the guests;
1.2 “Cottage” means such cottage(s) that Daylesford may have available for hire and which you wish to hire as shown in the booking confirmation;
1.4 “booking” means the agreement for hire of the Cottage(s) for the booking dates between you and Daylesford which shall be made when you have completed either the online booking form or telephone booking and Daylesford has confirmed the hire;
1.5 “booking date(s)” means the dates that you have booked for use of the Cottage(s);
1.6 “guests” means those people staying in the Cottage(s)
2.1 Charges for the hire of the Cottage and any other goods and services to be provided by Daylesford shall be in accordance with a scale of charges provided by Daylesford from time to time. Daylesford reserves the right to review the charges from time to time but undertakes to honour all bookings at the charge quoted at the time of booking.
2.2 Daylesford requires full payment of the Cottage hire charge upon confirmation of the booking. Payment may be made by any of the following card payments: Visa, Delta, Electron, Paypal, Mastercard, Eurocard, Mastro
2.3 Bookings are required to be for a minimum stay of three nights on the weekend (Friday, Saturday, Sunday) and four nights midweek (Monday, Tuesday, Wednesday, Thursday).
2.4 With regard to the scale of charges payable:
Low Season is considered to be February and November
Peak Season is considered to be Easter and Christmas (being a week either side of Easter weekend and Christmas Day) and also the week of the Cheltenham Festival and Big Feastival.
High Season is all remaining periods.
3. TREATMENTS & OTHER ACTIVITIES
3.1 The Charges include a one (1) hour treatment per adult guest in the Bamford Haybarn Spa, being a choice from a Bespoke Facial, De-Stress Massage, Pregnancy Massage or a Deep Tissue Massage.
3.2 Treatments included with your cottage booking are non-transferable, non-exchangeable, non-refundable and there is no cash alternative.
3.3 The value of the treatment(s) is not refundable and may not be used towards payment of any other activity upon the Daylesford estate even if you or any guest chose not to take the treatment(s).
3.4 Daylesford will seek to ensure treatment times at the Bamford Haybarn Spa at times convenient for each guest. On the rare occasion that an appointment is not available during the stay then the cottage team will contact you.
3.5 Guests are able to add to their experience at additional cost by booking additional Haybarn Sp treatments and workshops, a Cookery School Course or other bespoke Daylesford experiences. Please enquire for details of availability and costs.
3.6 An itinerary will be provided upon completion of your booking.
4. CANCELLATION & CHANGES
4.1 In the event that you cancel the booking, Daylesford shall charge a cancellation administration fee of £75 and reserves the right to impose cancellation charges, (which shall be deducted from the amount refunded to you) in accordance with the following rules:
4.1.1 more than six weeks prior to the booking date the full amount paid shall be refunded (less the £75 cancellation administration charge);
4.1.2 more than 22 days but less than 6 weeks before the booking date, 50% of the full hire charge will be refundable (less the £75 cancellation administration charge);
4.1.3 less than 22 days before the booking date the full hire charge will be payable and no amount shall be refunded and you shall be required to make payment to Daylesford of the £75 cancellation administration charge.
4.2 Should Daylesford receive another booking for the booking dates after cancellation by you, all or a portion of the advance fee may be refunded to you in addition to the amounts detailed above at the absolute discretion of Daylesford, subject to Daylesford deducting the £75 cancellation administration charge.
4.3 Daylesford do not operate or offer an insurance policy for cancellations.
4.4 To make alterations to your booking please contact our Daylesford team directly on 01608 731 717 or firstname.lastname@example.org and we will do our best to accommodate your requirements subject to the cancellation charges above.
5. TERMINATION BY DAYLESFORD
5.1 Daylesford reserves the right to refuse any request for booking at its discretion without reason.
5.2 Daylesford may at any time cancel the booking or refuse you and your guests the right to use the Cottage(s) during the booking date(s) in the event of you or any guest failing to perform any of the obligations contained within these terms and conditions.
5.3 In the event that Daylesford cancels the booking or refuses the right to use pursuant to Condition 5.2 above, Daylesford shall be under no obligation or liability whatsoever to you or any guest, and neither you nor any guest shall make any claim whatsoever against Daylesford in relation to the booking. In no event shall Daylesford be liable for consequential damages of any nature for any reason whatsoever, including but not limited to, transport costs.
5.4. Daylesford reserves the right to close the Cottage and to cancel or interrupt any booking without notice and without any liability legal or otherwise to you or any person affected by such a cancellation (such as any guest) in the event of war, riot, state of emergency, act of God, fire, flood, civil commotion or where any member of the public is at risk or thought to be at risk, strike (whether official or not), accident, failure of electricity or gas or any other service to the Cottage, however caused, or for any other reason whatsoever outside the control of Daylesford whereby Daylesford is unable to perform its obligations.
5.5 In the event that Daylesford cancels or interrupts a booking pursuant to clause 5.4 you shall be entitled to claim from Daylesford and Daylesford shall pay to you such sums as you have paid to Daylesford for the booking. This shall be the full liability of Daylesford in this circumstance. In no event shall Daylesford be liable for consequential damages of any nature for any reason whatsoever, including transport costs.
6. CHECK IN AND CHECK OUT
6.1 You and the guests shall use and shall only be permitted to use the Cottage(s) on the dates specified on the booking and in accordance with the following check in and check out times:
Check-In – 4pm onwards from first date of booking
Departure – by 10am on the final morning of the stay
6.2 Early check-in is not available due to Daylesford ensuring it has sufficient time to ensure the Cottage is ready for your arrival.
6.3 Late check-out may be possible but by prior arrangement with Daylesford only at its discretion and will be subject to an additional fee which would be advised at the time of the request.
6.4 If you expect to arrive considerably late in the evening then please let the cottage team know in advance so we know when to expect you.
6.5 Access and key instructions will be provided upon completion of your booking.
7. NUMBER OF GUESTS
7.1 Each Cottage has a maximum number of permitted guests as indicated on the Website and when booking which must not be exceeded.
7.2 The number of persons attending the Cottage shall not exceed the number of guests agreed at the time of booking.
7.3 Babies and children are welcome but are included towards the total number of guests.
8. WELCOME PACK
8.1 On arrival you will receive a welcome pack of tea, coffee, sugar, milk, butter, eggs and fresh bread from our bakery.
8.2 The kitchen is stocked with washing-up liquid, hand-sanitizer, multi-surface cleaner, dishwasher tablets, tea towels, laundry liquid, fabric conditioner and a good stock of firewood and firelighters.
8.3 The bathrooms are provided with complimentary samples of Bamford shampoo, conditioner, body wash and body lotion, soap and bath salts.
8.4 All linen is provided including dressing gowns and towels (although please note not bedding for travel cot). Should linen or dressing gowns be removed from the cottages a charge will be made to your credit card for the cost of the same.
9. USE OF THE COTTAGE
9.1 You shall ensure that use of the Cottage is conducted in an orderly fashion without causing a nuisance and in full compliance with any directions of Daylesford as may be made known through instructions in the welcome book or within the Cottage and estate or as you may be informed by the cottage or estate team.
9.2 All fire exits and passageways shall be kept free from obstruction at all times and no fire appliances shall be removed or tampered with in any way.
9.3 Smoking is not permitted anywhere within the Cottage(s) but is permitted in the Cottage garden. Please dispose of cigarettes responsibly. Smoking inside of a Cottage may result in an additional charge for cleaning.
9.4 Guests are required to take all reasonable precautions to ensure that no damage occurs to the Cottage(s), its finishes, fittings, furniture and contents or any other property at Daylesford. In the event of damage, Daylesford may at its own option have such damage repaired or damaged items replaced or repaired and charge you for the cost.
9.5 Nothing may be fixed to the floors, walls, ceilings or any other interior or exterior of the Cottage by any means (including drawing pins or blu-tak) unless agreed by the cottage team.
9.6 Daylesford and the cottage team may enter the Cottage(s) during the period of booking in the case of emergencies or other reasonable circumstances.
9.7 The Cottage should be left in a clean and tidy condition at the end of the booking, free from rubbish, with all washing up complete and dishwasher emptied, for which cleaning materials have been provided. Should extra cleaning be necessary beyond that reasonably expected Daylesford reserves the right to make an additional charge to you.
9.8 Due to the cottages close proximity to one another, we kindly ask that noise in the evening is kept to a minimum, with no disturbance after 11pm.
10. CAR PARKING
Each cottage is provided with a car parking space via the designated drive separate from the Farmshop car park. Please note the Farmshop car park gates are locked overnight and not opened until 8am Monday – Saturday and 10am on Sunday.
11.1 Daylesford is a working farm and accordingly access by you and the guests is prohibitive. You and guests can view the farm only from public footpaths which are clearly marked and be mindful of farm machinery and animals.
11.2 Please stick to public footpaths and close gates behind you.
11.3 Smoking is not permitted anywhere within indoor facilities on the estate.
11.4 If taking photographs, please be mindful of the privacy of other guests and visitors.
11.5 Please be aware that Daylesford is a working farm and a developing site. You may find reasonable activity and accompanying noise within normal working hours. However in the instance of any works taking place outside of this we will ensure to make you aware in advance of your stay.
12.1 Guide dogs accompanying visually impaired people are permitted without charge.
12.2 Small to medium sized well-behaved and controlled dogs (no bigger than a Labrador) are welcome at a charge of £30 per dog per stay to a maximum of two dogs (except the Egg Store which is a maximum of one).
12.3 Dog litter bags are provided in the Cottage with a designated waste bin on site. Guests are asked not to use the communal gardens for their dogs bathroom trips.
12.4 Daylesford may at any time cancel the booking or refuse you and your guests during the period covered by the booking the right to use the Cottage(s) hired in the event of your dog not behaving in the expected manner.
12.5 In the event that Daylesford cancels the booking or refuses the right to use the Cottage(s) pursuant to Condition 12.4 above, Daylesford shall be under no obligation or liability whatsoever to you or any guest, and neither you nor any guest shall make any claim whatsoever against Daylesford in relation to the booking. In no event shall Daylesford be liable for consequential damages of any nature for any reason whatsoever, including but not limited to, transport costs.
13. BABY EQUIPMENT
Please advise in advance if you require a travel cot or high chairs, which are available at no extra charge. Bedding is not supplied for the travel cot.
14. YOUR PROPERTY
14.1 Daylesford cannot accept responsibility for any of your or the guests property and shall not be liable for any loss or damage to property brought to the Cottage or left behind including any car or other vehicle.
14.2 In the event that you do leave property behind on departure and these are recovered by the cottage team then we can arrange for these to be returned to you, to a UK address only, by secure signed for post at a charge of £8.
15. COTTAGES Accessibility for disabled patrons
We have one cottage that is suitable for use by persons with reduced mobility, The Egg Store is all on ground floor level, but please be aware it has a full size bath with an overhead shower. Please do telephone if you have specific requirements. Our staff are happy to help and give best advice.
These terms and conditions shall be binding upon you and all guests subject to any overriding provisions expressly agreed with the cottage team in writing.
